About Family-Based Immigration

Family-based immigration allows a relative of someone who is a lawful permanent resident or citizen of the United States to obtain lawful permanent residency. Different categories of family-based immigration exist. If you want to apply to bring a relative to the United States, your category will depend on your relationship with this person, as well as whether you are a citizen or a lawful permanent resident. 


Relatives who may qualify to come to the United States using this method include:


  • Your spouse 
  • Children
  • Parents
  • Siblings


The Family-Based Immigration Process

The process of bringing a family member to the United States begins with filing an I-130 Petition. When submitting this form, you must also include:


  • Proof of your United States immigration status
  • Proof of your relationship with your relative
  • Proof that you can provide support for the relative at least 125 percent over the poverty line


If you are unable to provide enough financial support, you may be able to qualify with a joint sponsor. Once this petition has been approved, the Department of State will put your relative on the list to receive an immigrant visa number. For immediate relatives, which include your spouse or children under the age of 21, visa numbers should be available immediately. Other relatives may need to wait longer before receiving their number.
